The director discovered the genre of melodrama at the end of the 1960s, when it was being discussed as a complex socio-critical construct with hidden metaphors, visual finesse and subversive potential. At the same time, feminist research was scrutinizing melodrama. Laura Mulvey drew on psychoanalysis to describe the fetishising gaze at women, constructed as an object for the male gaze of the main character and the viewer who identifies with him. These two gazes are combined in particular when women perform songs in genre cinema, but such scenes do not advance the plot: “For a moment the sexual impact of the performing woman takes the film into a no-man’s-land outside its own time and space.” However, Mulvey recognises a further development of these gaze structures in Fassbinder’s films that are now fixed on those characters in positions of oppression. In his first melodrama, HANDLER DER VIER JAHRESZEITEN (The Merchant of Four Seasons, 1971), the gaze takes in both women and men.

According to Mulvey’s approving verdict, all of Fassbinder’s characters are “in an ambiguous and oppressed situation [...] in relation to their class and family, men who are trapped, as women are, in a way they can neither grasp nor articulate." It is not only that the gaze in Fassbinder’s melodramas that functions independently of gender; the accompanying inclusion of the viewer is also altered by it. While this may be emotionally bound up with the plot, the film constantly makes reference to the viewer's own reality. In everyday situations, Fassbinder exposes his characters to the marginalising gazes of others —family, neighbours, colleagues and so on — thus using private constellations to illustrate the social system based on exclusion and suppression. Im FAUSTRECHT DER FREIHEIT and HANDLER DER VIER JAHRESZEITEN it is more the capitalist circumstances that are depicted in the private sphere; in MARTHA, Fassbinder portrays marriage as a form of institutionalised relationship of violence.
